What information do we collect?

We may use the information we collect from you when you register, purchase products, enter a contest or promotion, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways: To personalize your site experience and to allow us to deliver the type of content and product offerings in which you are most interested. If you have opted-in to receive our e-mail newsletter, we may send you periodic e-mails. If you would no longer like to receive promotional e-mail from us, please refer to the “How can you opt-out, remove or modify information you have provided to us?” section below. If you have not opted-in to receive e-mail newsletters, you will not receive these e-mails. Visitors who register or participate in other site features such as marketing programs and ‘members-only’ content will be given a choice whether they would like to be on our e-mail list and receive e-mail communications from us.

How do we protect visitor information?

We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above.

How can you opt-out, remove or modify information you have provided to us?

To modify your e-mail subscriptions, please let us know by simply sending us an email. Please note that due to email production schedules you may receive any emails already in production. To delete all of your online account information from our database, please email us and we will remove you. Please note that we may maintain information about an individual sales transaction in order to service that transaction and for record keeping. Third party links In an attempt to provide you with increased value, we may include third party links on our site. These linked sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these linked sites (including if a specific link does not work). TERMS + CONDITIONS

School of game design (“School of game design” “we” “us” or “our”) develops training for emerging digital artists using a unique tutorial based teaching approach designed by industry professionals available to students via the School of game design website. Some School of game design Services are available to you for free, while others require that you create a User Profile Account and pay a Membership Fee for access. Access to and use of the services, whether accessed with or without payment are subject to the terms and conditions of this Agreement.

By subscribing to the Services or creating a User Account, you also agree to the provisions of the School of Game Design Privacy Policy which are all incorporated herein by reference. This Agreement and Privacy Policy include important legal information, including the exclusion of certain warranties and remedies. You are responsible for reviewing this Agreement and the Privacy Policy. The School of game design Terms and Conditions and Privacy Policy may be amended from time to time. School of game design will take steps to provide notice on the Site of changes to the Terms and Conditions and Privacy Policy.

Profile Accounts

In order to obtain access to the Services, you must create a School of game design profile account (“User Profile Account”) and pay the appropriate fees for access to the services you request. By creating a User Profile Account, you represent and warrant the information you provide is accurate and complete. You may never use another’s account or share your User Account with others. An institution may not purchase a single user account and share that user account among multiple employees. You are responsible for maintaining the security of your password and are solely responsible for the activity that occurs on your User Account. If you believe your User Account has been breached or used in any unauthorized manner, you must notify a School of game design representative immediately. School of game design is not responsible for any damage or losses caused by unauthorized use of your User Account. You, however, may be responsible to School of game design for any harm School of game design incurs due to unauthorized use of your School of game design User Account.

Membership Fees

School of Game Design offers services on a one-time membership fee basis. You agree to pay the Membership Fees and any other charges incurred in connection with your User Account (including any applicable taxes) at the rates in effect when the charges were incurred. We will bill all charges automatically to your credit card, PayPal account or other payment method that School of game design offers and you select. For any services billed by invoice, all payments are due net thirty (30) days from the date of the invoice.

Billing

Unless we state in writing otherwise, all fees and charges are nonrefundable. We may change the fees and charges then in effect, or add new fees or charges, by giving you notice in advance. If you want to use a different credit card than one previously provided or there is a change in credit card validity or expiration date, or if you believe someone has accessed the Services using your user name and password without your authorization, you must contact us immediately. You are responsible for any fees or charges incurred to access the Services through an Internet access provider or other third-party service. For example, the Services may include large video files. You are responsible for payment of any bandwidth, data, or subscription charges you may incur from a service provider while utilizing the Services.

Personal Information

When creating a User Account or using the Services, you will provide certain personal information to us (“User Information”). In addition to any provisions of our Privacy Policy, you agree that we may use your User Information to contact you regarding services we provide. We may also provide your e-mail address or contact information you provide to our affiliates for marketing our services. If you would prefer not to receive marketing or advertising, you must notify us by contacting us at [email protected] and requesting removal from our contact lists. School of game design uses a third party to process credit card purchases and does not retain records that include full credit card account numbers. School of game design may, however, obtain and retain portions, such as the last four digits, of a credit card number in order to later verify customer purchases.

Proprietary Rights

All Training Materials, content, organization, graphics, design, compilation, digital conversion and other matters related to or included on the Site are protected under applicable copyright, trademark, patent or other proprietary (including but not limited to intellectual property) rights. The copying, modifying, distributing, transmitting, displaying, selling, licensing, using, publishing or creating derivative works by you of any such matters or any part of the Site, except as expressly allowed by the Agreement, is strictly prohibited. You do not acquire ownership rights to any Content or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.

Downloading Materials

School of game design may make certain Training Materials available through download services operated by or in affiliation with School of game design. In order to access these Training Materials, you must agree to and comply with any end user license agreements or terms and conditions associated with the downloaded Training Materials as well as these Terms and Conditions. Except as authorized by School of game design, you are not permitted to capture streamed videos or download videos from the Site in any manner that is not provided by School of game design.

Tracking and Monitoring

School of game design implements technology and procedures to track usage of the Site and its Services, including tracking and monitoring associated with individual user accounts. By utilizing the Site and Services, you consent to tracking and monitoring of your use of the Site and Services. If School of game design determines, in its sole discretion, that you have engaged in any activities in breach of these Terms and Conditions or the Privacy Policy, School of game design may immediately terminate your account. You shall not be entitled to a refund for any fees paid. School of game design also reserves all legal rights, claims and causes of actions that it may have against you.

Trademarks / Service Marks

SCHOOL OF GAME DESIGN, SCHOOLOFGAMEDESIGN.COM, School Of Interactive Design, LLC logo are trademarks and/or service marks of School of Interactive Design, LLC. Other product and company names may be mentioned on the Site from time to time, which may be trademarks or service marks of their respective owners. These trademarks and/or service marks may not be reproduced without the express written consent of the respective trademark or service mark owner.

Term and Termination

This agreement shall be in effect as of the date you create your User Profile Account. The term of the Agreement for billing purposes shall begin as of the Membership Start Date.

Termination by You

You may terminate your User Account at any time by notifying us of your desire to terminate. After receiving notice from you, we will terminate your account. You will not receive a refund for any fees paid to School of game design.

Termination by School of Game Design

School of game design may terminate your User Account with or without cause and without notice when terminated for cause. If you believe your User Account has been terminated in error, contact School of game design at [email protected]. For example, School of game design may terminate a User Account, if it determines you have provided others with access to Training Materials with your User Account. If it is determined by School of game design, in its sole discretion, that your User Account was terminated in error, School of game design will provide you with access to the Services at no charge for the period of time in which your User Account was terminated. This shall be the sole and exclusive remedy available to you for any termination in error. If School of game design terminates your account for cause, determined at the sole discretion of School of game design, you will not receive a refund for any Membership Fees paid to School of game design. If School of game design terminates your User Account without cause, as determined by School of game design in its discretion, School of game design will provide you with a pro rated refund of payments made to you for the Services.

Limited License

By subscribing to the Services, School of game design grants you a limited, non-exclusive license to view the Training Materials via the School of game design website. This license shall terminate immediately upon termination of your Services. Following termination of your User Account, you shall immediately destroy any Training Materials or other content obtained through the Services. The Training Materials are the sole and exclusive property of School of game design or the respective creators of the Training Materials. Nothing herein grants you any ownership rights in the Training Materials.

You are not authorized to:

  • Share your User Account with others;
  • Allow more than one individual to access a User Account;
  • Copy, modify, distribute, capture, or save locally any of the Training Materials;
  • Remove any copyright or proprietary notice included on or in any Training Materials;
  • Circumvent or attempt to circumvent any encryption, security code, or other protection used in connection with the Training Materials;
  • Use the Services for any unlawful purposes;
  • Capture screen shots of Training Materials; or
  • Make Training Materials available to others in any format.

Representation of Ownership. School of Interactive Design represents and warrants that it is the sole and exclusive owner of the videos and tutorials included within the Training Materials (the “Content”), or otherwise holds sufficient rights in the Content to provide the Content to its users.

 

Warranty Disclaimer

EXPECT AS EXPRESSLY STATED OTHERWISE IN THE REPRESENTATION OF OWNERSHIP SECTION ABOVE, ALL MATERIALS SCHOOL OF GAME DESIGN PROVIDES ARE PROVIDED “AS IS”. SCHOOL OF GAME DESIGN DOES NOT WARRANT THAT TRAINING MATERIALS OR SERVICES PROVIDED IN CONNECTION THEREWITH WILL MEET YOUR REQUIREMENTS OR THAT THEIR OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT THE CONTENTS OF THE TRAINING MATERIALS ARE ACCURATE OR COMPLETE. SCHOOLOFGAMEDESIGN.COM MAKES NO WARRANTIES, EXPRESS, IMPLIED OR ARISING BY CUSTOM OR TRADE USAGE RELATING TO THE TRAINING MATERIALS OR RELATED SERVICES, AND WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Limitations on LIABILITY

IN NO EVENT SHALL SCHOOLOFGAMEDESIGN.COM AND/OR ITS AFFILIATES, MEMBERS, AGENTS, EMPLOYEES, LICENSORS OR SUPPLIERS BE LIABLE FOR ANY PUNITIVE, CONSEQUENTIAL, OR MULTIPLE DAMAGES OR LOST PROFITS OR OTHER SPECIAL, DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING ANY DAMAGES RESULTING FROM LOSS OF BUSINESS ARISING OUT OF OR IN CONNECTION WITH THE TRAINING MATERIALS OR RELATED SERVICES, EVEN IF SCHOOLOFGAMEDESIGN.COM HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR IF SUCH DAMAGES WERE FORESEEABLE. IN ANY EVENT, OTHER THAN BREACH OF SCHOOL OF GAME DESIGN’S BREACH OF ITS REPRESENTATION OF ONWERSHIP, SCHOOL OF GAME DESIGN’S AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL BE LIMITED TO THE AMOUNT YOU HAVE PAID TO SCHOOL OF INTERACTIVE DESIGN FOR THE THREE MONTHS PRECEDING ANY ACTION FILED.

Territorial Restrictions

The Services may not be available in certain territories due to certain national or international restrictions. By utilizing the Services, you represent and warrant that you are authorized under all applicable laws to access the Services.

Indemnity

You agree to defend, indemnify and hold harmless School of Game Design, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from:

  • 1. your violation of this Agreement or Privacy Policy;
  • 2. your violation of any third party right, including without limitation any copyright, property, or privacy right; or
  • 3. any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive termination of this Agreement and your use of the Services.

 

No Waiver

You are responsible for reviewing the Terms and Conditions as well as the Privacy Policy. If you do not agree to any of the Terms and Conditions or Privacy Policy, do not proceed with the use of the School of Game Design’s website services.
